Terms of Service

These terms are a contract between you and Avenir Marche Limited, a company registered in Saint Vincent and the Grenadines (“Sivex”, “we”, “us”). They apply to sivex.io, the Sivex web app and the Sivex mobile app (together, the “Service”). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

Our Privacy Policy, Risk Disclaimer, Availability page and Responsible Trading page form part of these terms.

1. What Sivex is

Sivex runs skill-based trading competitions. Every player in a tournament receives the same amount of virtual starting capital and trades it against live market prices for a fixed time. Players are ranked by a published score, and prizes go to the top of the ranking.

  • The trading capital inside a tournament is virtual. You do not buy, sell or hold any real asset through a tournament trade.
  • Sivex is not a broker, an exchange, an investment adviser or a fund. Nothing on the Service is investment, legal or tax advice.
  • We do not take the other side of your trades. Our income is the platform fee described in section 6.

2. Who can use Sivex

  • You must be at least 18 years old, and of legal age where you live.
  • You must not live in, or use the Service from, a restricted place. The current list is on the Availability page. We may change it.
  • You must not be on any sanctions list, or act for someone who is.
  • You are responsible for checking that taking part in paid skill competitions is lawful where you are. We do not promise that it is.
  • You must not use a VPN, proxy or false details to get around a restriction.

3. Your account

  • One person, one account. Accounts cannot be sold, shared or transferred.
  • The information you give us must be true and kept up to date.
  • Keep your sign-in details and devices secure. You are responsible for activity on your account until you tell us it has been compromised.
  • We may ask you to verify your identity, age, address or the source of your funds at any time. Until you do, we may limit deposits, entries or withdrawals.

4. Balances, deposits and withdrawals

  • Your Balance is shown in US dollars and is funded with the supported stablecoins on the supported networks shown in the app. It is not a bank deposit, earns no interest and is not covered by any deposit protection scheme.
  • Send only the supported asset on the supported network to your deposit address. Funds sent in another asset, on another network, or below the minimum shown may be lost and we may not be able to recover them.
  • Deposits are credited after the number of network confirmations shown in the app.
  • Withdrawals go to the address you give us. Blockchain transfers cannot be reversed, so check the address and network before you confirm.
  • A withdrawal carries the network fee shown before you confirm. If you withdraw money that you deposited and have not used to enter a tournament, a processing fee of 3% applies to that unplayed part. Winnings and money you have played are withdrawn first and do not carry this fee.
  • Withdrawal limits depend on your verification level. We may hold a withdrawal for review where we need to complete identity, fraud or legal checks.
  • You must use your own funds and your own wallet. We may refuse or return a deposit, and may ask where the funds came from.

5. Promotional balances and rewards

Free Cash, S-Cash, passes, shields, tickets and similar rewards are promotional. They are not money, cannot be bought, sold or transferred, and cannot be withdrawn. They can be used only as shown in the app, may expire, and may be removed if they were obtained in breach of these terms. How a prize won with a promotional balance is paid is shown at entry.

6. Tournaments, fees and prizes

  • The entry fee, format, instruments, start time, scoring rules and prize structure of each tournament are shown before you enter. By entering, you accept them.
  • We keep a platform fee from the entry fees collected. It is currently 10% or 8% on scheduled tournaments, depending on the stake, and 7% on custom matches. Free tournaments carry no fee. The rate for each tournament is fixed when it is created.
  • Prize pools are made from entry fees after the platform fee and any side-game shares shown on the tournament page, unless a guaranteed amount is stated. The final pool depends on the number of entries.
  • Rankings use the published scoring rules. Prizes are credited to your Balance after the tournament is settled.
  • You can leave a scheduled tournament and get your entry back until registration closes, where the app offers it. After that, entries are final.
  • If a scheduled tournament does not reach its minimum number of players, or we cancel it, every entry is returned to the balance it was paid from.
  • Custom matches cannot be cancelled once created. If a custom match does not reach its minimum, entries are returned as above.
  • Market prices come from third-party feeds. If a feed fails, is delayed, or shows a clearly wrong price, we may pause, extend, void or re-settle the affected trades or tournament, and return entries where a fair result is not possible.
  • Tournament records are committed to a public blockchain so results can be checked on the Verify page. Subject to the point above and to section 7, a settled result is final.
  • You are responsible for any tax due on your prizes. We do not withhold or report tax for you unless the law requires it.

7. Fair play

You must not:

  • open or control more than one account, or play on someone else’s account;
  • collude with other players, share positions to fix a ranking, or agree to split or pass prizes;
  • use bots, scripts or automated tools to trade, or interfere with the Service, its prices or its systems;
  • exploit a bug, a wrong price or a system error instead of reporting it;
  • abuse a bonus, referral or creator programme, including by referring yourself;
  • use the Service to launder money or to move funds that are not yours;
  • harass, threaten or abuse other users or our staff.

If we reasonably believe you have broken these rules, we may void your results, withhold or reverse prizes and rewards, return entry fees to the players affected, and suspend or close your account.

8. Creators, crews and referrals

Hosted tournaments, crews, creator commissions and the referral programme run on the rules shown in the app and on their own pages. We may change or end any of these programmes. Amounts already earned and credited under the rules in force at the time are not affected.

9. Paid memberships

If you buy a membership such as Sivex Pass, the price, length and what it includes are shown before you pay. It renews for the same period at the then-current price until you cancel in your account settings. Payments are not refundable except where the law requires it.

10. Staying in control

You can set a deposit limit, take a cooling-off break or exclude yourself in your account settings. While a break or exclusion is active, you cannot deposit or enter paid tournaments. You can always withdraw your Balance. Enter only with money you can afford to lose.

11. Your content

You are responsible for what you post in chat, on your profile and in crew pages. Do not post anything unlawful, hateful, sexual, misleading or that infringes someone else’s rights. We may remove content and restrict chat. You give us a free, worldwide licence to show your username, profile, results and posts on the Service and in our marketing.

12. Our rights in the Service

The Service, the Sivex name and logo, the software, the scoring system and the content we produce belong to us or our licensors. You may use the Service for your own personal play. You may not copy, resell, scrape or reverse engineer it.

13. Suspending or closing an account

  • You can close your account at any time by contacting us. Withdraw your Balance first.
  • We may suspend or close an account that breaks these terms, fails a verification check, is in a restricted place, or where the law requires it.
  • When an account is closed, we return the withdrawable Balance to you after any checks, unless the law prevents it or the funds came from a breach of section 7. Promotional balances are cancelled.

14. No warranty

The Service is provided as it is and as available. We do not promise that it will be uninterrupted, free of errors, or that prices shown will match any other market. Trading skill does not guarantee a prize, and past results do not predict future ones. You can lose every entry fee you pay.

15. Limit of our liability

To the extent the law allows, we are not liable for lost profits, lost opportunity, loss of data, or any indirect or consequential loss; for failures of blockchains, wallets, price feeds, internet or other services we do not control; or for funds sent to a wrong address or network. Our total liability to you for all claims in any 12-month period is limited to the greater of the platform fees you paid us in that period and USD 100. Nothing in these terms limits liability that cannot be limited by law, including for fraud.

16. Your responsibility to us

You will cover our reasonable losses and costs that result from your breach of these terms, your breach of any law, or your misuse of the Service.

17. Changes

We may change the Service and these terms. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using the Service after that, you accept the change. Tournaments you have already entered stay on the rules shown when you entered.

18. Law and disputes

These terms are governed by the laws of Saint Vincent and the Grenadines. Contact us first and give us 30 days to resolve a complaint. If it is not resolved, the courts of Saint Vincent and the Grenadines have exclusive jurisdiction, unless the law where you live gives you a right that cannot be removed.

19. General

  • If part of these terms is found to be unenforceable, the rest still applies.
  • If we do not enforce a term at once, we can still enforce it later.
  • You may not transfer your rights under these terms. We may transfer ours to a company in our group or to a successor of the business.
  • These terms, and the documents they refer to, are the whole agreement between you and us about the Service.
